CORRELATION OF BUILDING LEASEHOLD AND LEASEHOLD OF A PLOT OF LAND FOR THE PURPOSES OF BUILDING

Abstract. The article is devoted to a relevant nowadays problem - understanding the advantages of the promising institution of superficies. The author examines the theoretical and practical issues of the correlation of building leasehold and leasehold of a plot of land for the purposes of building. In connection with the adoption of the Conception of the Civil Legislation Development and the Project of the Civil Code of the Russian Federation the paper analyzes the merits and demerits of the suggested limited proprietary right. The researcher aims to justify possible changes and evaluate the usability of building leasehold. On the basis of the conducted analysis the author concludes on the necessity for the theoretical improvement of the suggested construction with a view to create a complete and perfect system of proprietary rights, to stimulate investment activity and efficiently secure builders’ rights.
