COMPLETING REAL ESTATE TRANSACTIONS WITHOUT NOTARIAL CERTIFICATION: RISKS FOR THE SUBJECTS OF CIVIL TURNOVER

Abstract. In the article on the basis of the analysis of judicial practice the possible risks of the parties when concluding the contracts for the alienation of real estate in a simple written form are identified. In the author’s opinion, a large file of judicial practice in disputing real estate transactions, concluded in a simple written form, is a consequence of the lack of legislation requiring the mandatory notarial certification of most common real estate transactions. In order to ensure the stability of the civil turnover of real estate and the protection of personal non-property and property rights of citizens, the author grounds the need to return in the legislation the requirement for a mandatory notarial form for real estate transactions.
