Abstract. The article provides a comparative historical analysis of the motives to acquire the right of property and the institution of the restricted right of enjoyment as they are interpreted in "Institutes" by Gaius, one of the best descriptions of the Roman classical private law system, and the Russian civil legislation. Examining jura in re aliena according to Gaius, the paper identifies the nature of usufruct, the ways to establish usufruct through mancipation and juridical cession, the usufruct subject and the possibility to acquire income by slaves held in usufruct. The author argues that the current Russian law of property borrowed certain norms from the institutions of the Roman law of property.
