Abstract. Punishment, being one of the forms of official legal enforcement, acts as a factor of providing lawfulness, at the same time this legal institute is analyzed not only from the point of view of judicial science but also philosophy. The paper considers the genesis of punishment taking into account several aspects of the origin of the state and law. In the contemporary theory of law the issues of the development of philosophical conceptions about punishments aren’t paid much attention to, and even more seldom the philosophical aspects of administrative punishments are examined in the modern theory.
