SUBJECT OF DODGING CONSCRIPTION AND PERFORMANCE OF ALTERNATIVE CIVILIAN SERVICE

Abstract. In the article the content of the additional features of the special subjects of the bodies of crimes stipulated by Article 328 of the Criminal Code of the Russian Federation is revealed. Their notion with the purpose of right classification in law-enforcement practice is formulated. The problem of conscription and assigning to alternative civilian service of the citizens of the Russian Federation convicted according to the mentioned article regardless of the presence of previous conviction is considered. The necessity to fix an appropriate proposition in the law "On Military Obligation and Military Service" is pointed out.
