JURIDICAL AND HISTORICAL-PHILOSOPHICAL ASPECTS OF CUSTOM IN LEGAL REGULATION OF ENTREPRENEURIAL ACTIVITY IN THE RUSSIAN FEDERATION

Abstract. The article reveals the natural-legal characteristics of the mechanisms of entrepreneurial activity legal regulation by the example of custom. Two directions are considered: natural-legal as "prior given", revealed in "scholastic" spirit basing on the law sources of "superior" power; and natural-legal as the result of the processes of the existence of spontaneous, self-generating market order, formed, inter alia, with the human’s actions not directly connected among themselves, each of which doesn’t pursue the achievement of any common purpose, with which the result of these actions, perceived at a certain moment in time and space, can be identified. Custom in the modern Russian legislation is considered as a mechanism allowing the realization of the procedure of the law "opening" and, as a result, - the objective development of market order.
