HORSE-STEALING AND LYNCHING IN COMMON LAW SYSTEM OF PROVINCIAL RUSSIA IN THE SECOND HALF OF THE XIX TH CENTURY

Abstract. The article considers the social-jural phenomenon of lynching in the Russian common law. The author proves that lynching was an extraordinary measure in the Russian countryside and was used only in the extreme cases of serious crimes. Horse-stealing was attributed to such crimes in rural community and was followed by the severe punishment of the criminal. The severity of the punishments was almost equal in different regions of provincial Russia. Arguments are adduced that lynching in general was contradictory to the legal mentality of the Russian peasants.
