DEPARTMENTAL PROCEDURAL CONTROL AS INVESTIGATIVE ORGANIZATION HEAD’S MAIN MEANS OF PRELIMINARY INVESTIGATION LEGALITY ENSURING

Abstract. In the article the main elements of the investigative organization head’s departmental procedural control are revealed, such as: guidances giving, illegal decisions cancellation, case transfer, petitions examination, reconciliation and so on. Special attention is paid to considering the investigative organization head’s right to examine petitions, which is not legislatively secured, and it is suggested introducing corresponding changes into criminal-procedural legislation currently in force. Basing on departmental procedural control elements analysis the author gives its definition.
