FORMATION AND IMPLEMENTATION OF PRESUMED CONSENT FOR DONATION IN AUSTRIA

Abstract. The author reveals the basic stages of the formation history and the features of the modern transplantation legislation in Austria, considers the current transplantation law from the point of view of the presumed consent for donation used in Austria and the influence of judicial practice on the choice of this model, and basing on the statistical data on the quantitative level of donation in the country comes to the conclusion about the effectiveness of this legislative solution.
