HISTORICAL-PHILOSOPHICAL TRADITIONS OF JURY TRIAL AS MEMBER OF MARKET-ECONOMIC ENTREPRENEURIAL RELATIONS

Abstract. The author conducts the analysis of jury trial as the mechanism of civil society control over economic and state power in the sphere of market-economic entrepreneurial relations, takes two conditions as the basis of jury trial capabilities estimation: 1. the features of market-economic entrepreneurial relations sphere associated with its potential instability and unpredictability that requires the determination of law content in this sphere, and 2. the political-legal thesis about people as the media and source of power; and considers the possibility of applying legal proceedings with jury trial participation in arbitration and civil proceedings.
