Abstract. The author analyzes the notions of positive legal liability existing in domestic legal science, pays special attention to the consideration of positive liability as a legal relation (general and specific), and concludes that the general legal relations of positive liability are manifested in the mutual lawful (legal) behaviour of legal relations subjects, and specific legal relations occur under the influence of encouraging norms.
