Abstract. The author considers the procedural order of the criminal court legal composition formation, and basing on the analysis of foreign experience, as well as the problems of the existing practice of assigning cases to judges in Russia substantiates a number of propositions on bridging the gaps of the existing legislation: about the need to adopt the rules of assigning cases to judges by the general meeting of each court judges, as well as the consolidation of the procedural order for making the decision to assign the case to a particular judge in the Criminal-Procedural Code.
