PHILOSOPHICAL FOUNDATIONS AND SOCIAL-CULTURAL CONSEQUENCES OF PUNISHMENT ALTERNATIVE METHODS

Abstract. The author analyzes the theories that are the basis for classical penitentiary system formation, shows theoretical contradictions and social-cultural conflicts that occur as a consequence of penitentiary system functioning, which provoke the development of the methods for non-custodial sentence, presents the critical analysis and comparison of the international documents affirming the norms of alternative punishment methods with domestic reality, and as a result suggests the classification of the social and cultural barriers preventing the use of non-custodial sentence methods.
