INTERNATIONAL ASPECTS OF PROTECTION OF CITIZENS’ CONSTITUTIONAL RIGHTS TO INHERITANCE

Abstract. The author reveals the content and elements of the international mechanism of the protection of right to inheritance, mentions that its object is social relations in the sphere of international-legal regulation and the protection of right to inheritance, pays special attention to the conventional regulation of rights to inheritance, analyzes the European Court of Human Rights practice in the sphere of ensuring the implementation of the right under study, comes to the conclusion that the legal protection of this right is carried out on the basis of common rules contained in national conflict norms, and also special rules contained in international treaties and agreements of the Russian Federation with foreign states, and tells that significant differences in the domestic legislation, as well as the problems of conflict norms collision often create difficulties in the implementation of the right to inheritance guaranteed by the RF Constitution.
