CORRELATION OF GENOCIDE CRIME INTERNATIONAL-LEGAL UNDERSTANDING AND SOME NORMS OF THE RUSSIAN FEDERATION CRIMINAL CODE OF 1996

Abstract. The criminal-legal characteristic of the notion "genocide" is given in the article. International-legal norms influence on the Russian criminal legislation is shown; the problem of the practical impossibility of this component application due to the hardship of the intent ascertainment aimed at some persons group depopulation is emphasized. The concrete wordings of the deeds suggested for criminalization are given, Article 357 exclusion from the Criminal Code of the Russian Federation is substantiated, and it is suggested to terminate The Convention on the Prevention and Punishment of the Crime of Genocide of 9 December 1948.
