Abstract. The author presents the analysis of economic policy as a legal phenomenon, in such quality considers economic policy as a state economic function element, as the way of organizing its implementation by executive branch, shows that a government's economic policy mechanisms are formed in connection with market conditions provision for social relations reproduction, and among them in connection with the provision and implementation of human and legal state rights and freedoms theory considers civil society as a legal subject that controls the implementation of government economic policy balancing a state in its influence on economy by establishing the limits of such intervention.
