Abstract. The author pays attention to the legal nature of real estate trust management agreement, on the basis of the criteria of the differentiation between property and contractual law developed by civil law science comes to the conclusion that legal relationships between a managing trustee and a trustor falls into the category of contractual ones, singles out and describes the characteristic features of this agreement that allow distinguishing it from other agreements of such a kind, and basing on the analysis of the subject matter specificity of real estate trust management agreement states that it should be isolated into an independent institution of civil law.
