BUSINESS INTERCOURSE CUSTOM AND BUSINESS HABIT: PROBLEMS OF CORRELATION

Abstract. The author considers the problem of the differentiation between business intercourse customs and business habits as the closely related categories of civil law, suggests such differentiation criteria as the legal effect of customs and habits, the sequence of their occurrence, the necessity of publicity to parties, and comes to the conclusion about the necessity of the differentiation between customs and habits, because different legal nature of these phenomena conditions different order of their presence and content proof in court.
