Abstract. The author studies one of the features of custom as the source of the Russian law - its sanctioning by the state, reveals the notion of sanctioning and existing in scientific literature points of view on the meaning and sense of sanctioning, determines the goals of customs sanctioning, and considering the ways of customs sanctioning, emphasizes the state sanctioning and its differentiation as legislative, law enforcement, departmental, contractual and implied.
