JURIDICAL TERMSMISARUM ANDANDURARUM: SIMILARITIES, DIFFERENCES AND THEIR ROLE IN LAW DEVELOPMENT IN ANCIENT EAST OF THE END OF THE IIIRD - THE MIDDLE OF THE IIND MILLENNIA B. C.

Abstract. The author considers the two legal terms which can be frequently met in the documents of Southern Mesopotamia since the end of the IIIrd millennium B.C. - misarum and andurarum. The first of them is used both in official public-legal and private-legal texts. The second one was first of all used in law enforcement practice.On the basis of the detailed studyingof source base the following conclusions can be made: each of the terms initially corresponded to one of the two different legal traditions; by the middle of the XVIIIth century B.C. the juridical notion andurarum was included into misarum but at the same time the category misarum remains a public-legal one and in private documents either the term andurarum is applied or the corresponding tsar's decree is mentioned (simdat sarrim).
