Abstract. The author researches public law role in the formation of the territorial-tribal state which appeared within the territory of Eshnunna kingdom at the beginning of the IInd millennium and singles out the basic criteria which help to identify the belonging to territorial-tribal states on the basis of studying both private-law and public-law documents. The most important of them are the following ones: distinctly formed state structure of management, social-legal balance in delimiting spheres of influence between tsar and community and active development of foreign trade.
