TAKING INTO ACCOUNT ASSISTANCE TO LAW ENFORCEMENT AGENCIES AS POSITIVE POST-CRIMINAL BEHAVIOUR STIMULATION

Abstract. The article is devoted to the problem of punishment infliction taking into account a culprit's positive post-criminal behavior, particularly, his (her) assistance to investigation. The article considers the correlation of the norms of General Part of Criminal Code taking into account assistance to investigation while inflicting punishment, analyzes the legal nature of pre-trial agreement and its correlation with the circumstances mitigating punishment.
