Abstract. In the article the author studies the problem of civil-legal status of state in privity, considers the historical peculiarities of its formation and points out the lacks of legislation and lacunas in law science. The author makes a conclusion concerning the necessity of the adoption of new laws series and additions to the acting civil law.
