Abstract. In the article the actual problem which has to be solved because of the last legislative changes is considered. The author analyzed the mechanisms of the protection of constitutional rights and freedom of a person and a citizen in the Russian Federation. To the author's mind the most important instruments of the guarantees assurance of the constitutional rights and freedom of a person and a citizen under the conditions of the social society formation in Russia are an ombudsman, judicial authority and, of course, the public prosecutor's office of the Russian Federation.
