RELEVANT PROBLEMS OF THEORETICAL UNDERSTANDING AND PRACTICAL IMPLEMENTATION OF THE CONCEPTION OF APPELLATE PROCESS IN CIVIL PROCEDURE

Abstract. This article discusses the problem of theoretical understanding and practical implementation of the existing conception of appellate process in civil procedure. The author reveals the main ideas that are typical for this kind of legal proceedings on the basis of the conducted historical analysis. In the paper it is concluded that development of the institution of appellate process is possible in case of fundamental restructuring of the judicial system expressed in expanding boundaries of application of the auditing principle and transformation of reviewing authority.
